Selling into the Netherlands?

Here's what you owe, and who decides.

Rijkswaterstaat receives producer notifications and the Human Environment and Transport Inspectorate (ILT) supervises the rules. Verpact and the other stream bodies run separate routes. We keep all four files distinct and their dates in one calendar.

Who carries it

Two answers decide whether any of this is yours.

Where your company is established, and whether you sell to consumers or through a local reseller. Those two put you on one of four routes, and the route decides who places the goods on the market in the Netherlands for the first time: the person the law calls the producer.

  • EU seller, selling to consumers

    You place the goods on the market in each country you ship to, so you are the producer there, even without a company in it.

  • EU seller, selling through a reseller

    Your local reseller is often the first to place the goods on the national market, which can make them the producer instead of you. It depends on the country, and it is the first thing we check.

  • Non-EU seller, selling to consumers

    You are the producer in each country you ship to. Several of them also require a representative established there, a role we can fill.

  • Non-EU seller, selling through a reseller

    Whoever imports into the EU usually becomes the producer. That may be your reseller, and it may be you. Several countries also require a representative established there.

Streams

Four streams. They never share a file.

Packaging goes to the packaging scheme, electronics to the WEEE register, batteries to the battery register. Mixing them is the most common reason a file comes back.

    The textile route covers consumer clothing, workwear and specified household textiles. A non-resident producer appoints a representative established in the Netherlands.

The Netherlands uses a different route for each stream. Verpact handles packaging, the National (W)EEE Register handles electronics, and textile producers notify Rijkswaterstaat.

  • Submit each stream separately, to its own register or scheme.
  • File the declarations that follow, on the calendar the Netherlands runs.
  • Record every response from ILT, Rijkswaterstaat and the schemes, and tell you what it means in plain English.
  • Resubmit at no extra fee if a file we prepared comes back.

Questions about the Netherlands

Three answers we give on every file in the Netherlands.

They are the same three everywhere we run, and only the names change. The scope check answers the first one for your company in about five minutes; ILT and Rijkswaterstaat decide the second, which is why we say what we do about it rather than what we obtain.

Do I need a company in the Netherlands?

No. This is built for non-resident sellers. Depending on the country and stream you may need an authorised representative established there. That's a role we can fill, and the scope check says whether you need one.

What if the file is rejected?

It happens, usually because a product spec or a company document doesn't match. We tell you what came back, in plain English, and resubmit once it's fixed. No extra fee for a resubmission on a file we prepared.
