Some countries want someone established there to carry your obligations.

That someone is an authorised representative.

You do not need a company in the country you sell into — this is built for non-resident sellers. On some routes you do need a representative established in it, and working out which routes, in which countries, is the part that costs people time.

The five roles

Five roles. One of them is ours to fill.

Who carries the obligation is the question that comes before all the others. These five are the answers a register recognises, and only one of them can be handed to somebody else.

  • Producer

    Whoever places the product on a national market for the first time.

    Carries the obligation. This is the role you are in almost every time, even without a company in the country.

  • Non-resident seller

    A seller with no establishment in the country they sell into.

    Not a separate obligation — a situation. It is what makes the question of a representative come up at all.

  • Importer

    Whoever brings the product into the Union.

    Becomes the producer when they are the first to place it on the market. That may be your reseller, and it may be you.

  • Authorised representative

    We can fill this one

    An entity established in the country, mandated to carry a non-resident seller’s obligations there.

    Carries your obligations in that country, in your name. It is the one role on this list we can fill for you.

  • Marketplace

    The platform that hosts the sale.

    Does not carry the obligation, but controls it: Amazon asks for an EPR number and suspends listings without one.

When you probably need one

Two routes of four point to a representative. Probably is the right word.

Both are non-resident routes: a seller established outside the Union. The other two do not usually raise the question at all. What we will not do is turn “probably” into “yes” — the requirement depends on the country and on the stream, and only reading that country’s rules settles it.

  • EU seller, selling to consumers

    You place the goods on the market in each country you ship to, so you are the producer there, even without a company in it.

    Your local reseller is often the first to place the goods on the national market, which can make them the producer instead of you. It depends on the country, and it is the first thing we check.

    You are the producer in each country you ship to. Several of them also require a representative established there, a role we can fill.

    Whoever imports into the EU usually becomes the producer. That may be your reseller, and it may be you. Several countries also require a representative established there.

The map you get from the scope check says “probably” too, for the same reason. A person reads it against the country and the stream before anyone quotes you anything.

We can hold the mandate. You stay the producer.

A representative carries your obligations in a country. It does not move your product, your name or your liability somewhere else, and any provider who tells you otherwise is selling you something they cannot deliver.

  • What the mandate covers Being the established point of contact the register requires, and carrying the registration and declaration obligations we agreed, in your name.
  • What stays yours You remain the producer. You stay the member of the scheme and the debtor of its contribution, in your own name — that is how it works in Italy today, and we do not stand in for it.
  • What we don't promise That a representative is required for you, that we can act in every country you named, or that a register accepts a mandate on any given date. A person confirms all three before a quote.
